MORE  ACTION  ON  PRESENT  PROVISIONS  OF  LOKPAL  ACT  :  DELHI  HIGH COURT  STAYS  PUBLICATION  OF  ASSET  INFORMATION  IN  PUBLIC  DOMAIN  :  CONFEDERATION  WRITES  TO  CABINET  SECRETARY  AS  REQUESTED  BY  WEST  BENGAL  CIRCLE  UNION  ON  21.8.2014 & 08.9.2014  TO  FEDERATION



    A Division Bench of Delhi High Court has issued stay order on 9th September on the provision of the Lokpal Act to public declaration of assets of spouses and dependent children of Govt staff. The petitioner, Vinita Singla, wife of a Central Govt employee and working in a major IT company of India, termed the Govt dictate in her petition (Writ Petition  (Civil)No. 6010/2014 ) a violation of her 'fundamental rights of equality, life, personal liberty and privacy as flowing from Article 14 and 21 of the Constitution of India.'

    A division bench of justices S Ravindra Bhat and Vipin Sanghi issued notice to Ministry of Personnel, Public Grievances and Pensions, Ministry of Communications and IT and Ministry of Law and Justice, seeking their replies by November 24.  "Prima facie, there is merit in the petitioner's contention. She is a private citizen and declaration of her assets is violation of the Article 21 of the Constitution. Issue notice. Petitioner is directed to furnish the information in sealed cover which would be handed over to the authorities concerned. This order shall remain in force till final disposal of the case," the bench said.

    The bench also directed the ministries concerned to ensure that the secrecy of documents is maintained. Selaed envelopes reaching all departments will not be opened till further order from the Bench.

    The Confederation of Central Govt Employees & Workers has also raised the issue through a letter issued yesterday to the Cabinet Secretary requesting to take necessary action not to display asset information in public domain which would leave all staff vulnerable to security threats, kidnapping and demanding ransom etc. 

   It is worth mentioning that West Bengal Circle Union brought the issue into the notice of Federation at very early stage through e-mails on 21.8.2014 and 08.09.2014.

LAST  DATE  OF  LOKPAL  RETURN  DEFERRED  THROUGH  GAZETTE  NOTIFICATION ~~~~ NEW  COMMITTEE  FORMED ~~~~ STAND  OF  WEST  BENGAL  GROUP-C  CIRCLE  UNION  IS  AGAIN  PROVED  JUSTIFIED

    In a significant development, Central Govt today has circulated a copy of Gazette Notification (Extraordinary) dated 08.9.2014, deferring the last date of filing Lokpal Return by all staff till 31st December 2014  instead of present 15.9.2014.  

    A committee has been formed on 28.08.2014 to make suitable changes to the forms of Return and the process of the declaration. They will submit their report within 45 days (mid-October). 

      Regarding the threat of security to our staff and their family upon displaying all assets in the website, the observation and demand of West Bengal Group-C Circle Union have been almost reciprocated in the order (Gazette), which reads as ---

   'And whereas, concerns and apprehensions have been raised by some Ministries/Departments, Organisations and individuals about the posting of every information provided by the public servant on public domain and the complexities involved in posting such details in the prescribed formats and also about exacerbation of vulnerabilities of the public servants after filing such details, specifically of movable property and their publication on the websites of respective Ministries/Departments giving rise to apprehension of the safety and security of the members particularly children of the public servant;'

PRESIDENCY  ZONAL  COMMITTEE  MEETING  HELD  AT  BARUIPUR, SOUTH PRESIDENCY DIVISION

   The Presidency Zonal Committee meeting of the Circle Unions was held at 'Dak Andolan Bhavan', Baruipur in South Presidency Division on 7th September 2014. Leaders of North Presidency, Barasat, Nadia South, Nadia North, Murshidabad, Birbhum and South Presidency participated in the meeting. Circle Secretaries of Group-C, Postmen & MTS, GDS(NFPE), AIPSBCOEA and Postal Workers' Union ---- all were present in the meeting. The meeting was presided over by a presidium led by senior leader Com. Ashok Mondal.

    The inaugural speech was delivered by Com. Nirmal Dey, followed by deliberations of secretaries or their representatives from all divisions of the zone. Problems of the divisions, status of membership, attacks of the administration, review of organisational programs etc. were discussed in details. From Postmaster cadre Com. Sanat Das and on behalf of PO-RMS Accountants Com. Bhaskar Majumder raised relevant points. Com. Mukul Das, Treasurer, P-IV Circle Union, stressed on timely remittance of quota and clearing all dues to Circle/All India Unions. The meeting concluded with the speech of Com. Janardan Majumder elaborating the characteristics and changes of the pattern of administrative attacks on officials and organisations in the backdrop of present political scenario of the state and the country. He emphasised on the unity of the members and putting best efforts to come out of the present days of hardship.

       In the meeting, Murshidabad division has declared their decision to host the Circle Council meeting. Birbhum division is considering the feasibility of holding the next Circle Conference there, the decision is yet to be finalised by their committees.

      The Circle Unions have assessed the outcome of the meeting as very categorical, brief yet effective.

NFPE & FNPO ANNOUNCE
MASSIVE PARLIAMENT MARCH OF 20000 POSTAL & RMS EMPLOYEES INCLUDING GRAMIN DAK SEVAKS ON
10th DECEMBER 2014 AT NEW DELHI
                      Demanding settlement of Postal JCA (NFPE & FNPO)
                          charter of demands submitted to Govt. and Postal Board.
PREPARE FOR INDEFINITE STRIKE IF GOVT. REFUSES TO SETTLE THE DEMANDS
          Twenty Thousand (20000) Postal & RMS employees including Gramin Dak Sevaks will march to Parliament on 10-12-2014, demanding immediate settlement of charter of demands submitted postal JCA to Govt. and Postal Board. All Branch / Divisional / Circle Secretaries of all affiliated Unions / Associations of NFPE & FNPO (P3, P4, R3, R4, Admin, Postal Accounts, SBCO, Civil Wing and GDS) are requested to start preparations now onwards to ensure maximum participation of members in the Parliament March. Let us make it a historic success.

CENTRAL GOVT  CONSIDERS  TO AMEND  LOKPAL & LOKAYUKTAS ACT 2013  TO  SAFEGUARD  EMPLOYEES  FROM  SECURITY  THREATS : EFFORTS  AND  THOUGHTS  OF  WEST  BENGAL  GROUP-C  CIRCLE  UNION  IS  PROVED  JUSTIFIED
   
    As the department has directed all employees to furnish all immovable and movable assets of entire family including cash in hand, deposited cash in Bank or P.O. savings accounts, fixed deposits, jewellery etc., for displaying these information in departmental website as per the provisions of the above Acts, a panic prevailed among all employees regarding security. There are enough possibilities for using these information by miscreants for extortion, demanding ransom by kidnapping etc.

      Our Circle Union realised the threat of the situation and sent an e-mail to P3 CHQ on 21.8.2014 expressing our concern over the issue. The text of the e-mail was :

Dear Comrade,
                          You must be aware of the fact that our department has already circulated a 6-page proforma for declaration of assets and liabilities by staff, their spouses and dependent children, as required under Section 44(2) of Lokpal and Lokayukt Act 2013. These information will be made available in the Public Domain of the departmental website as per the provisions of the Act.

         We had a discussion in the Circle Union regarding this. Our comrades are anxious over the issue of security once entire assets aredisplayed in public domain. Everyone is apprehending threat to security as any miscreant would have easy access to such information, and especially in West Bengal, where now it is the hegemony of miscreants for ransom and extortion even by the local clubs to extract money, none would be spared.

         We need to know whether the CHQ or the Federation has pondered over this aspect of the situation and thought of any remedy. As this is an Act now, no local or departmental remedy is feasible. Can we seek a minimum protection of these information in the departmental website under user id and password? The password may then be supplied to Lokpal Officers also.

         Kindly intimate us the stand and thinking of the CHQ and Federation / Confederation on it. We shall decide our stand upon that.

     We are happy to see a news item appearing in today's 'TIMES OF INDIA' (Kolkata edition) that DoPT has also received various apprehensions from different sources and the Central Govt is seriously considering to amend the Act for not making information pertaining to movable assets available in public domain (departmental website).    If this amendment is made, we have to furnish all assets alright, but movable assets will not be available in the website for any public. We welcome the decision of the Govt and request for immediate process for the amendment.

      Meanwhile, West Bengal Circle Unions are going to issue a letter shortly to the Circle Administration for not being hyperactive to upload everything in public domain, and also to the CHQ, Federation and Confederation requesting to take this up with Postal Directorate and DoPT as early as possible.
